As Zune is not registered as a trademark by anybody to do with AROS I don't believe there would be a leg to stand on. And as the two are from totally separate technology sectors a trademark wouldn't even be a valid reason to sue.

Microsoft commonly takes terms for their own use, only dealing with the rightful owners after they get sued over it (cough - Vista - cough).

David would have to be the one to push it since he is the "owner" of Zune. This is one of the down sides of being a tiny OOS, few legal protections against corps.

The point is that I don?t think David has registered the Name as a Trademark since you have to pay for it. You also have to register in the different countries and in a certain catalogue (where you would like to use the trademark for like computers, software, tooth paste.. whatever ...), so there are quite a lot possibilities.

Personally I don?t think Microsoft is about to do anythink againts "our" Zune, even if I don?t know if they have registered the name in the software catalogue since there is no big danger of mixing-up the products.

But you might ask a lawyer friend for a 100% answer.

The Zune name does indeed belong to David Le Corfec, and, as far as the web remembers, it was always called Zune.

Zune's freshmeat page.

Original Zune site.

With some money and a company behind our backs we could sue MS without we can only sit by and let them use the name as they feel fit.

Why, let's send them a "Cease and Desist" letter, let the net talk about it, sit back and have some fun.

That might prove to be successful, after all, in a way or another.

Seriously, anyone with me?

Yes (though it might depend on whether the C&D letter is of the homemade or commercial variety ).
